Terms of sale

SWAN-ID and SWAN-Network — version 1, draft of 20 September 2026, to be reviewed by a lawyer before publication. Legal references are given for checking.

Working translation of the French text. In case of divergence, the French version prevails (article 10).

1. Parties and scope

These terms of sale (the "terms") govern every order placed on the sites swan-id.com and network.swan-id.com (the "sites") with:

(hereinafter "SWAN-ID").

They apply to anyone who buys a product or a service on the sites (the "client"). By placing an order, the client declares having read and accepted the terms. The terms in force are those published on the sites on the day of the order; SWAN-ID may amend them for the future, with no effect on orders already placed.

2. Products and services

SWAN-ID offers:

a) digital products, delivered by email: the CV Generator, episode analyses, fact sheets and documents, the Club's online courses; b) French courses, online for individuals, on site for companies and institutions, at the prices shown on network.swan-id.com; c) services priced on proposal: communication tracks, audits and company training programmes.

For services priced on proposal, the proposal accepted in writing — signature or email — forms part of the contract together with these terms. Where they diverge, the proposal prevails for what it sets out.

The content published on swan-id.com (articles, episodes, tools) is accessible without an order and is not the object of a contract of sale; article 8 applies to it.

3. Prices and payment

Prices are in Swiss francs (CHF), excluding VAT: SWAN-ID is not registered for value added tax. Should registration become necessary, VAT will be added to the prices shown from that date, with no effect on orders already paid for.

Digital products: paid online, at the time of the order, by card or by Twint through Stripe. The product is delivered once payment is confirmed.

French courses for individuals: billed monthly, at the beginning of the month, for the number of sessions planned in that month. The invoice is payable before the first session of the month, by bank transfer (QR-invoice). Sessions postponed or owed under article 6 are carried to the following month's invoice.

Services on proposal and company programmes: 50% of the amount on acceptance of the proposal, 30% at an intermediate date set in the proposal, 20% on delivery of the final deliverable, before the closing session. Payment by bank transfer against invoice.

In case of late payment, SWAN-ID may suspend services not yet provided after a written reminder has gone unanswered for ten days.

4. Delivery of digital products

Digital products are sent by email to the address given by the client, as a file or as a download link with a limited lifetime. The client is responsible for the accuracy of their email address.

For the CV Generator, the data entered by the client is deleted 48 hours after the document is delivered; after that, no new generation is possible without a new order.

A product not received within 24 hours of payment is sent again free of charge on request to contact@swan-id.com, once the address has been checked.

5. What is owed

Swiss law provides no right of withdrawal for purchases concluded online. Accordingly:

  • a digital product once delivered is owed;
  • a booked course session is owed under the conditions of article 6;
  • a deposit paid on a service priced on proposal remains acquired for the work already engaged.

A session cancelled by SWAN-ID is postponed free of charge to a date agreed with the client or, failing that, credited on the next invoice. A defective digital product — unreadable file, incomplete document — is replaced free of charge.

Reference: the right of withdrawal of art. 40a ff. CO concerns doorstep selling and does not apply to online commerce.

6. French courses

Trial hour and assessment. The first hour is free; it includes the level assessment. It is booked on an agreed slot and commits the client to nothing.

Cycles. A cycle covers the programme of one level of the Common European Framework of Reference for Languages. It opens with a placement assessment and closes with an assessment stating whether the level is acquired. The course covers the programme; the level acquired depends on personal work between sessions, at the rate of one hour for every hour of class. If the final assessment does not confirm the level, seven one-to-one remediation hours are offered at the one-to-one rate.

Rhythm. Sessions last one hour. The rhythm, from one to five sessions a week, is chosen on enrolment and sets the length of the cycle. The hourly price does not depend on the rhythm.

Postponement and cancellation by the client.

  • More than a week before the session: postponed free of charge, to an agreed date.
  • Between one week and 48 hours before the session: postponed within the same week; in a group, the catch-up session is one-to-one and carries a surcharge of CHF 20; one-to-one, the postponement is free of charge.
  • Less than 48 hours before the session: the session is owed and is not postponed.
  • On presentation of a medical certificate, the session is postponed free of charge whatever the notice.

Groups. A group has three to six participants. If a group falls below three participants, SWAN-ID offers a postponement, a move to one-to-one at the one-to-one rate, or the end of the cycle with no charge for the sessions not given.

Companies and institutions. The programme, the number of participants, the place and the schedule are set in the proposal. Sessions are held on site, on the client's premises, and are billed per session according to the proposal.

7. Services priced on proposal

Proposal. Every service priced on proposal is preceded by a first conversation. The proposal describes the service, the deliverables, the schedule, the price and the payment dates. It is valid for thirty days.

Deliverables. Unless the proposal states otherwise, each service or stage gives rise to a written document (PDF), a presentation support and a closing session of thirty minutes to one hour, two hours at most. The technical build — site, funnel, tools — may be entrusted to a third party under SWAN-ID's responsibility.

Confidentiality. The information and documents handed over by the client for the performance of the service are confidential. This obligation extends to the people SWAN-ID associates with the service, in particular practitioners taking part in an assessment or a session.

Ownership of deliverables. The deliverables specific to the client — their positioning, their offers, their client journey, the lexicon specific to their company in a communication reference — belong to them once payment is complete. The methods, the templates and the general part of a reference — the scope of a profession or of a sector — remain the property of SWAN-ID, which may reuse them for other clients without disclosing any of the client's information.

Change and termination. Any change of scope is the object of an amendment to the proposal. If the client ends the service, the deposits paid remain acquired and the work done beyond them is billed pro rata.

8. Liability

The content published on swan-id.com — articles, episodes, tools, fact sheets — is provided for information. Every rule quoted carries its source and the date it was checked; decisions belong to the competent authorities, schools, administrations and employers, and SWAN-ID is no substitute for individual legal, tax or administrative advice.

The calculation and conversion tools give indicative results, as each tool states.

SWAN-ID's liability for an order is limited to the amount paid for that order, save in case of gross negligence or intent. SWAN-ID is not liable for indirect damage or loss of profit.

9. Personal data

The processing of personal data is described in the privacy policy published on the sites. The data is hosted in Switzerland. The client has the rights provided by the Federal Act on Data Protection (FADP), exercised by email to contact@swan-id.com.

10. Language, applicable law and jurisdiction

These terms exist in French, English and German. The English and German versions are translations, the German version having been produced with the help of artificial intelligence. In case of divergence or dispute, the French version prevails.

The contract is subject to Swiss law. The place of jurisdiction is Biel/Bienne. The jurisdiction of the consumer's domicile remains reserved where the law so provides.
